FAQs – Disputes

A formal dispute can be raised if a Project Owner refuses to release the funds after a project’s completion and is unable to come to a resolution with the Construction Company who carried out the work.

In the event that this happens, PongoPay will give both parties the option to appoint independent mediator to find a resolution. Both parties will be asked to provide an account of the issue which the mediator will review in order to help reach an outcome which both parties are happy with. If the mediator is unable to resolve the issue in a way which satisfies both parties, a PongoPay administrator will recommend arbitration or adjudication.

A PongoPay administrator also reserves the right to decide who will receive funds. This is usually only implemented if PongoPay believes a party is being unreasonable or acting maliciously.

PongoPay is designed to prevent construction disputes. It does not affect your right to take independent legal action in the event of a dispute.

If a job runs over budget or there are significant variations to work, you can add additional payment stages during the job. Both parties must agree to this.
